Terms of Service
Contract terms for the use of the RintUp service.
1. Parties and acceptance
This agreement is concluded between [COMPANY NAME] ([ADDRESS], MERSIS: [MERSIS NO]) ("RintUp") and the natural or legal person who creates an account at rintup.com ("Customer") when the Customer accepts these terms electronically during sign-up. A person signing up on behalf of a legal entity represents that they are authorised to bind it. The Turkish version prevails in case of conflict.
2. Definitions
- Service: website, API, server and SSL certificate monitoring; alert notifications; status pages; the panel and the application programming interface (API).
- Workspace: the account unit containing the Customer's monitors, members and settings.
- Monitor: a definition for checking a target chosen by the Customer at regular intervals.
- Customer data: all data entered into the service by the Customer and its members or generated through the service.
- Plan: a subscription plan whose price and usage limits (number of monitors, check interval, SMS quota etc.) are published at rintup.com.
3. Account and security
- The Customer is responsible for keeping registration details accurate and up to date; you must be at least 18 years old to open an account.
- The Customer is responsible for keeping passwords, API keys and two-factor devices confidential and must notify RintUp immediately of any unauthorised use.
- The workspace owner is responsible for the actions of the members it adds and the API keys it creates.
4. Scope of the service
RintUp checks the targets defined by the Customer at the intervals and from the locations allowed by the plan, sends alerts to the selected channels on status changes and serves the status pages the Customer publishes. Check results and availability figures reflect what RintUp's measurement points see; they do not guarantee reachability from other networks.
Alert delivery depends on third-party infrastructure (e-mail, SMS operators, chat services). RintUp delivers alerts with reasonable care and is not liable for consequences of delays or losses in that infrastructure. Using more than one alert channel is recommended for critical systems.
5. Acceptable use
The Customer may not use the service to:
- Monitor, scan or put load on systems it does not own or is not authorised to monitor
- Use the service as a tool for denial-of-service attacks, vulnerability scanning or unauthorised access attempts
- Attempt to reach internal networks, cloud metadata services or RintUp's infrastructure, or to bypass security boundaries
- Publish unlawful, misleading or defamatory content on status pages or impersonate third parties
- Use the SMS and e-mail channels to send unsolicited messages
- Circumvent plan limits by opening multiple accounts or by technical means
If these rules are breached, RintUp may suspend the monitor or the account with prior notice or, where there is serious risk, immediately. Notices of unlawful content are handled in our capacity as hosting provider under Law No. 5651.
6. Customer data and personal data
The Customer owns customer data. RintUp processes customer data only to provide the service, ensure security and meet legal obligations. For personal data the Customer enters into the service, the Customer is the data controller and RintUp the data processor; this relationship is governed by the Data Processing Addendum, which forms an integral part of this agreement.
For data RintUp processes as controller, the KVKK Privacy Notice and the Privacy Policy apply. The Customer ensures that people it adds as alert recipients are informed and, where necessary, have given consent.
7. Fees and payment
- Paid plans are billed in advance monthly or yearly and renew automatically for the same term unless cancelled. Prices are in Turkish lira and exclude VAT unless stated otherwise.
- Payments are collected through the licensed payment institution Paynkolay; card details are never sent to RintUp.
- If a payment fails, the Customer is notified and given a grace period of [7] days; after it the account may be moved to the free plan and monitors above the limit may be paused.
- Price changes are announced at least 30 days in advance and apply from the next renewal term.
- Upgrades take effect immediately, downgrades at the end of the term. Subject to the consumer rights below, unused time is not refunded.
8. Customers who are consumers
If the Customer is a consumer under Consumer Protection Law No. 6502, a preliminary information form and a distance contract are presented separately before payment under the Distance Contracts Regulation. For services performed instantly in electronic form, the right of withdrawal cannot be exercised once performance has started with the consumer's approval (Regulation Art. 15). Disputes may be brought before consumer arbitration committees within the monetary limits, or consumer courts above them.
Draft note: the preliminary information form and distance sales contract must be added to the payment flow; counsel should confirm that the withdrawal exception applies.
9. Availability and maintenance
RintUp operates the service with high availability as its goal but, unless a separate service level agreement (SLA) is signed, does not commit to a specific availability figure. Planned maintenance is announced in advance where possible. The service's own status is published on RintUp's status page ([RINTUP STATUS PAGE ADDRESS]).
10. Intellectual property
The software, design and trademarks of the service belong to RintUp. The Customer is granted a non-exclusive, non-transferable right to use the service for its own business purposes during the term. The Customer represents that it holds the necessary rights to logos and content it uses on status pages.
11. Limitation of liability
RintUp's total liability under this agreement is limited to the fees paid by the Customer in the 12 months before the damage occurred. Liability for indirect damages, loss of profit, loss of data and loss of reputation is excluded. These limitations do not apply in cases of intent or gross negligence, to personal injury, or to the extent mandatory consumer law does not allow them (Turkish Code of Obligations Art. 115).
12. Term and termination
- The agreement has no fixed term. The Customer may cancel the subscription in the panel at any time; cancellation takes effect at the end of the paid term.
- RintUp may terminate the agreement with 30 days' notice, or immediately in case of material breach.
- After termination customer data is deleted within 30 days; during that period the Customer can export its data via the API. Records subject to statutory retention (invoices etc.) are kept for the relevant period.
13. Changes
RintUp may change these terms. Changes to the Customer's detriment are notified by e-mail at least 30 days before they take effect, and the Customer may terminate during that period. Continuing to use the service after that period means accepting the new terms.
14. Governing law and disputes
This agreement is governed by the laws of the Republic of Türkiye. Subject to mandatory consumer protection rules, the courts and enforcement offices of [COMPETENT COURT — e.g. Istanbul (Çağlayan)] have jurisdiction. The parties agree that RintUp's electronic records constitute an evidence agreement under Code of Civil Procedure Art. 193; the right to submit counter-evidence is reserved.
15. Notices
Notices to the Customer are sent to the e-mail address on its account. Notices to RintUp are sent to the KEP address [REGISTERED E-MAIL (KEP) ADDRESS] or to [ADDRESS].
